VACANCY CIRCULAR
The Joint Electricity Regulatory Commission (JERC) for UT of 38K and UT of Ladakh has been notified by the Government of India under the provisions of the Electricity Act, 2003, vide notification 5.0.1984(E) dated 18.6.2020 with its headquarter at Jammu. The Commission consists of a Chairperson and one Member. The post of Member in the said JERC has been vacant since 30.06.2024,
2 Appointment to the post of Member, JERC for UTs of J&K and Ladakh shall be governed by the relevant provisions of the Elec tricity Act, 2003 and the Joint Electricity Regulatory Commission for Union Territories except Delhi (Salary, Allowances and other Conditions of Service of
Chairperson and Member) Rules, 2007 and as amended from time to time. Member of JERC of UT of J&K and UT of Ladakh shall be entitled to receive pay, as admissible to Secretary to the Government of India,
provided that if the Member is a retired Additional Secretary to the Government of India or equivalent or of any rank below, he shall be entitled to receive the pay as admissible to an Addi tional Secretary or the pay that an officer of the same rank as his at retirement would draw, whichever is lower.
3. Hon’ble Supreme Court vide its judgment dated 12.4.2018 in Civil Appeal No. 14697/2015- State of Gujarat & Others vs. Utility Users’ Welfare Association & Others, mandates that there should be one person from Law background in the Commission. As per the above judgment of the Supreme Court, a Member of the Commission,
shall be a person, who is, or has been holding a judicial office or is a person possessing professional qualifications with substantial experience in the practice of law, who has the requisite qualifications to have been appointed as a Judge of the High Court or a District Judge. Thus, the anticipated vacancy of member, JERC for UT of J&K and UT of Ladakh is to be filled in light of aforesaid judgment.
4. Member of JERC for UT of 38&K and UT of Ladakh shall hold office for a term of five years from the date on which he/ she joins office or attains the age of sixty-five years, whichever is earlier.
The candidate will have to give a declaration that he/she does not have any financial or other interest, which is likely to affect prejudicial his/her function as Member of the above JERC.
